Position Overview

The Compliance Manager – China will directly oversee and manage the day-to-day activities related to the Company’s Compliance Program in China. This position may also assist the Director, Legal and Compliance and Senior VP Law in managing the Company’s compliance program in the greater Asia Pac region as assigned. The ideal candidate willbe able to perform assignments with skill, knowledge and a high degree of independence. Typical duties:
  1. Responsible for the day-to-day compliance program administration, including ensuring training, field and corporate monitoring and auditing, identifying and escalating legal compliance risks,and occasionally local investigations as assigned by the Director, Legal and Compliance or Senior VP Law.
  2. Drive and ensure a culture of ethics and compliance in China and Asia Pac in collaboration with local leadership and employees.
  3. Advise all levels of employees and management with respect to ethics and compliance issues in China and Asia Pac as specifically assigned.
  4. Prepare routine healthcare professional services agreements in compliance with corporate guidance and send more complex agreements to the Director, Legal and Compliance or Senior VP Law for handling.
  5. Track, monitor and audit payments to healthcare professionals and government officials, including going into the field and ensuring that sales partners understand and follow applicable compliance requirements set out in contracts as well as ensuring payment terms are complied with.
  6. Maintain a database of hospital compliance guidelines and ensure local contract terms do not violate local hospital requirements when such guidelines available.
  7. Oversee the third party due diligence program, including clearing red flags, in China and when assigned do the same for Asia Pac.
  8. Implement compliance program controls and processes as directed by the Company from time-to-time in China and if requested in Asia Pac.
  9. Conduct local training on Company Policies, Codes of Ethics and other compliance topics as assigned.
  10. Conduct regular audits of the import, export and/or title transfer of Company product and share the results of such audits with the Director, Legal and Compliance or Senior VP Law.
  11. Monitor compliance updates in China and Asia Pac and share those updates timely with the Director, Legal and Compliance and Senior VP Lawand other internal clients as appropriate.
  12. Special projects as assigned
    1. Must have at least four (4) years of anti-corruption, compliance program management and/or auditing experience in a law firm, large accounting firm or in a multi-national corporate setting.
    2. Bilingual (Native in Chinese and fluent in both written and spoken English). Must have the ability to develop compliance policies and procedures, communicate and report in Chinese and English.
    3. Candidates with progressive responsibilities and/or compliance leadership are preferred.
    Desired Qualifications
    1. Demonstrated experience in medical device, pharmaceutical or other healthcare-related experience in a compliance role.
    2. Self-starter with the ability to function in an individual contributor role as well as work with others in a corporate Legal department.
    3. Able to support and solicit input from all levels within the organization and able to implement compliant solutions that are in line with Company policies and local laws in response to real time business needs.
    4. Demonstrated experience with keeping compliance files and documentation in line with leading practices.
    5. Expert knowledge of the AdvaMed Code of Ethics on Interactions with Health Care Professionals in China (“China Code”) and theAsia Pacific Medical Technology Association Code of Ethical Conduct (“APACMed Code”).
    6. Excellent facilitation and presentation skills.
    7. Ability to develop and integrate metrics into the projects and operations that clearly explain the compliance “why” to the business and to Corporate.
    8. Excellent judgement.
